KUALA LUMPUR – KUALA LUMPUR – Former Prime Minister, Datuk Seri Najib Tun Razak denied several allegations while giving his testimony under oath on the RM42 million funds belonging to SRC International Sdn Bhd.

According to Najib, as mentioned during the opening statement of his defence counsel Tan Sri Muhammad Shafee Abdullah, he did not hold any personal interest in SRC International, with the exception of the professional interest as the Prime Minister.

“I firmly state that I do not have any personal interest. On the contrary, as the Prime Minister and Finance Minister, it was my public responsibility to act on the best basis for the government of Malaysia,” he said.

When cross-examined by his lawyer, Najib flatly denied the allegations thrown on him earlier by the prosecution witnesses.

He also quoted the allegations by the former Chairman of SRC International, Tan Sri Ismee Ismail, who accused Najib for giving orders to the Board of Directors before a decision was made.

“I was actually shocked by the accusations by Tan Sri Ismee as they were baseless. Matters pertaining to the operation of the company, joint-venture with Aabar Investments PJS, financing, those were under the responsibility of the Board.

“The Board will discuss first before obtaining the approval from the Ministry of Finance Incorporated as the stakeholder of SRC International.

“I have never signed any document to instruct the Board of Directors on any such matters,” he said.

Najib also denied that he had ‘forced’ or directed for the constitution of SRC International to be amended so that he can gain the power to control the entity.

According to Najib, Article 67 and 116 in the Constitution of SRC International were amended prior to discussing with him.

“I was not involved in the inception of SRC nor any amendment of the constitution of the company. After reading the document on the inception of SRC, I knew that SRC was established through B&M Consultancy Services Sdn Bhd.

“Lim Poh Seng, was the then Company Secretary of 1MDB. The then Minister in Prime Minister’s Department Datuk Seri Nor Mohamed Yakcop headed the Economic Planning Unit (EPU) of the Prime Minister Department had approved the establishment of SRC International,” he said.

Najib said, government-linked companies have the same provision which grants authority to the Prime Minister to control the affairs in the company.

“If the court allows me to explain further, actually, the power of the Prime Minister in Petronas is more comprehensive that SRC.

“The Memorandum and Articles of Association (M&A) of Petronas stated that only the Prime Minister has the power to appoint its Chairman and its appointment must be in accordance to the instruction of the Prime Minister,” he said.

He also said that as the Prime Minister, although he had the power to approve RM3 billion of allocation for SRC International, he did not do so.

The trial which began at 9.30 am was adjourned at 5.00 pm and will resume tomorrow. – MalaysiaGazette
