MELAKA – A cleaner was sentenced to three years in jail by the Sessions Court today for attempting to murder his wife by strangling, beating and smothering her face with pillow.
Judge Maziah Joary Tajudin, passed the sentenced to the accused, M. Paramasivam, 49, after pleading guilty on three counts of charges at the Melaka Court Complex in Ayer Keroh.
According to the first charge, the accused attempted to murder his wife, M. Santhi, 48, by smothering the face of the victim using a pillow.
Under Section 307 of the Penal Code, he could be sentenced to maximum of 10 years in prison and fine; and if hurt is caused to any person by such act, the offender shall be liable to imprisonment for a term which may extend to twenty years.
The accused was also found to have voluntarily caused hurt to his wife by strangling and hitting her under Section 323 of the Penal Code and read together with Section 326A of the similar act which is punishable with imprisonment for a term which may extend to one year or with fine which may extend to RM2,000 or with both.
Meanwhile, for the third count of charge, the accused committed criminal intimidation by threatening the victim verbally with ‘it’s better that you die’ while pointing a screwdriver at her.
The offence under Section 506 of the Penal Code provides imprisonment for a term which may extend to two years or with fine or with both.
The accused was charged for committing all offences at a house at the Tehel People’s Housing Project, Bemban, Jasin at around 5.00 pm on 4 February 2020.
The unrepresented accused made a plea to reduce his sentence from the day he was arrested on 14 February 2021.
The prosecution was handled by Deputy Public Prosecutor, Intan Lyiana Zainal Abidin, who requested for a heavy punishment over the seriousness of the crime.
The court sentenced the accused to three years in jail for the first charge and one year each for the second and third charge to run concurrently from the date he was arrested. -MalaysiaGazette
