KUALA LUMPUR – The audio recording of a complaint on threat received by the fifth prosecution witness, Yasmin Nahar Mahmood’s father was played to the Kuala Lumpur Sessions Court today.
In that audio recording, Yasmin’s father called the Founder of Rumah Bonda, Siti Bainun Ahd Razali on the threat he received from a woman against her daughter, Yasmin.
Defence counsel, Nur A’minahtul Mardiah Md. Nor, said, the fifth prosecution witness had to give several false testimonies on Bella’s abuse case as she did not want to be sentenced to jail as alleged in the threat.
Defence counsel: I suggest that, these fabricated stories, although you do not agree, I suggest to you that you did it because you do not want to be the scapegoat. You don’t want to be charged in the court, agree?
Yasmin: No.
Defence counsel: This is in your own police report.
Yasmin: I am not sure.
Defence counsel: You lodged the report yourself, stating that your father was harassed, agree?
Yasmin: I am not sure.
Defence counsel: Not sure about what? In that report, you said that someone threatened your father, could be jailed for 30 years.
Yasmin: I am not sure.
The prosecution rose in objection to the questions presented by Nur A’minahtul Mardiah as the defence had asked the similar questions earlier.
Nur A’minahtul Mardiah then requested the court to play the audio recording of the conversation between Yasmin’s father and Siti Bainun on the threats he received.
Defence counsel: Do you remember, on the date of this incident on 22 July 2021 at the condo? I was there, Kak Lina was there, Puan Aisyah was there, you were there. A phone call was received.
Yasmin: I remember.
Defence counsel: Can you remember the voice in the telephone just now?
Yasmin: The voice in the telephone and the person who called was my father and the other person was Cik Siti Bainun.
Defence counsel: In that conversation, your father said that you could be jailed for 20 years.
Yasmin: I can’t hear it clearly actually.
Defence counsel: But can you confirm that this conversation happened at Siti Bainon’s house, in the presence of the lawyer? Agree?
Yasmin: Agree.
The defence counsel completed their cross-examination on the fifth prosecution witness at about 12.15pm before the court had a recess.
The trial resumed at 2.00 pm with the prosecution reexamining the witness before Judge Izralizam Sanusi. -MalaysiaGazette
