KUALA LUMPUR – Judge Mohd Nazlan Mohd Ghazali who heard the misappropriation trial involving SRC International Sdn Bhd (SRC International) trial allegedly has conflict of interest as he was the Company Secretary and General Counsel to Malayan Banking Berhad (Maybank). He was also the Head of Corporate and Legal Services for the bank.

According to Malaysia Today, Mohd Nazlan was working for the Securities Commission (SC) when the financing for 1Malaysia Development Berhad (1MDB) was arranged.

“It is now confirmed that Nazlan had dealt with his 1MDB counterpart Jasmine Loo, 1MDB’s General Counsel, who is now a fugitive along with Terence Geh Choh Heng and Casey Tang Keng Chee — all of them Jho Low’s people,” said the new portal.

On 28 July 2020, Mohd Nazlan convicted former Prime Minister Datuk Seri Najib Razak after he was found guilty on seven criminal breach of trust and money-laundering charges involving RM42 million belonging to SRC International. He also sentenced Najib to 12 years in prison and RM210 million in fine.

SRC International was a subsidiary of 1MDB.

According to that news portal, a copy of minutes of Maybank meeting showed that Mohd Nazlan was involved in matters pertaining the 1MDB besides the meeting approving the loan to 1MDB.

Yesterday, Najib’s defence counsel, Datuk Seri Shafee Abdullah said that Najib’s counsel had filed a new application to the Federal Court to present fresh evidence (on Nazlan who allegedly had conflict of interest) in the SRC appeal case.

“Over RM4 billion of loans from Maybank (to 1MDB for the acquisition of Tanjong). It went through various processes in Maybank, risk committee and the whole board of directors (Maybank).

“One of the committee members who got the instruction was the Head of Corporate and Legal Services for the bank, Group General Counsel, the number one chief of the corporate and legal department, Nazlan, the judge who heard the SRC case.

“He (Nazlan) should have recused himself as he would become the witness here (Najib’s 1MDB trial).

“If the prosecution did not call for him (Nazlan), we will call him. He went through all processes (Maybank’s loan to 1MDB) and he had certain opinion when the company failed to make payment,” said Shafee. -MalaysiaGazette
